Question:The Patent Cooperation Treaty facilitates the filing of applications for patents, it is presently adhered to by over 124 countries

Answer:
Another treaty, known as the Patent Cooperation Treaty, was negotiated at a diplomatic conference in Washington, D.C., in June of 1970. The treaty came into force on January 24, 1978, and is presently adhered to by over 124 countries, including the United States. The treaty facilitates the filing of applications for patent on the same invention in member countries by providing, among other things, for centralized filing procedures and a standardized application format.

Question:Does the USPTO control the fees charged by patent attorneys and agents for their services?

Answer:
No. This is a matter between you and your patent attorney or agent in which the Office takes no part. To avoid misunderstanding you may wish to ask for estimate charges for: (a) the search (b) preparation of the patent application, and (c) USPTO prosecution.

Question:Plant patents are granted for the entire plant, and only one claim is permitted.

Answer:
A plant patent is granted on the entire plant. It therefore follows that only one claim is necessary and only one is permitted.

Definition:
An application for patent filed under 35 U.S.C. 111(a) that includes all patent applications (i.e., utility, design, plant, and reissue) except provisional applications.

Office Action

Definition:
A letter from a trademark examining attorney setting forth the legal status of a trademark application. There are several types of Office actions: examiner’s amendments, priority actions, and suspension inquiry letters.
